Topic: Consumer Law Reform: Comparing Redress

The Australian Consumer Law is being amended following public consultations initiated five years after that nation-wide regime was implemented in 2011. The regime aimed to harmonise substantive consumer law domestically, but also to some extent with global best practice. But enforcement was not centralised, and redress mechanisms (such as small claims procedures and ADR processes) were not a focus in 2011 – or in the current review. Private international law problems are also not being addressed, despite burgeoning cross-border shopping and e-commerce. This talk elaborates on these issues and possible reasons for the relative disinterest in improving consumer redress mechanisms, comparing developments also in the EU and ASEAN.
